TOPSY CONTINUES TO STEAL MY © CONTENT.


READERS: If you want me to continue providing useful, original content then I urge you to join me fighting against these bottom feeding scum sucking content thefts who try to claim that they are a "search engine"

HERE IS MY LATEST MESSAGE TO THESE SCUMBAGS AT TOPSY.COM

a search engine does not archive and make available the ENTIRETY of copyright content it just indexes it for search, and sends viewers to the officially sanctioned version of that content.

stop hiding behind some bullshit claims that you are a "search engine" and admit to the fact that you are the biggest kind of content pirate scumbag on the internet.

i do not know how many FUCKING times I have to tell you to take down ANY and ALL content produced and owned by me immediately and permanently.

can you not read? my feed is labeled ©nyphonejacks, (that's copyright douche bag)  and the profile explicitly prohibits by name TOPSY from republishing ANY content on my feed, or elsewhere on the internet.

  1. Read the Twitter TOS. You grant twitter perpetual, irrevocable worldwide license to everything you tweet, including any partners they see fit to do business with.

  2. We have gone over this already. I have reviewed the TOS of Twitter, and they are on MY side! Topsy's scraping of my content is a violation of those TOS, not to mention copyright law, period, end of discussion!

    Not to mention how do you expect to be taken seriously when you post anonymously?

    1. You have options. Put up a robots.txt if you don't want places crawling your pages. Yahoo, Bing, and Google all do it. Check out Google Cache. They scrape the ENTIRE page when they crawl.

      And then there's the Wayback Machine from the Internet archive.

      This is how the internet WORKS. And if you'd bothered to read the law you'd see that you have no legal case whatsoever. Crawling content for search purposes is not infringement. If it were, google wouldn't exist.

    2. 1: you can not put in a robots.txt file on TWITTER

      2: crawling or indexing a page for search purposes is fine, Yahoo, Bing, and Google only lead people to the legitimate source of the information, they do not republish the entire contents in a different format making it appear that it is a legitimate source for the content. They merely allow someone to locate the actual source of the information. Topsy in no way makes it appear as if the information is coming from anywhere other than their website, they copy the entire contents, and make NO effort to send the viewer to the legitimate source of the information.

      3: Archive.org is just that - a HISTORICAL ARCHIVE of content posted on the internet. They do NOT publish recent content, AND do not make any attempts to mask where the original content is or was located.

      4: How exactly is it that I have no legal case when I have had their site taken off the internet several years ago for this same exact thing, and have continued to serve them with DCMA notice after DCMA notice, yet they fail to remove the infringing materials? I also clearly labeled my Twitter feed with a © and explicitly stated that the content within my feed is strictly forbiden from being republished on topsy.com specifically.
